Import & Compliance

Telecom equipment is regulated by the Autorité de Régulation des Télécommunications et des Postes (ARTP), established in 2001 under Law 2001-15, which governs type approval of radio and telecom equipment. ARTP type approval is mandatory for wireless and RF-emitting devices; non-RF server hardware — servers, drives, RAID, PSU, and NICs without RF — is generally exempt, but importers should confirm exemption with ARTP before shipping. Customs is administered by the Direction Générale des Douanes. Server hardware under HS 8471 (automatic data processing machines) sits in the ECOWAS/WAEMU Common External Tariff Category 1 at 0% import duty, with additional parafiscal levies on non-ECOWAS imports of approximately 3.8% (statistical fee 1%, Community Solidarity Levy 0.8%, ECOWAS Levy 0.5%, Customs Modernisation Programme levy 1.5%). VAT is 18% on CIF value plus duties, giving an effective landed-cost addition of roughly 21.8% for hardware imported from outside ECOWAS via air; sea shipments may carry an additional COSEC maritime levy. Pre-shipment inspection by Cotecna applies to shipments valued at or above XOF 3 million (~USD 5,000–6,000 depending on exchange rate). Buyers should confirm current sanctions, export-control eligibility, and exact duties and taxes with a licensed customs broker before each shipment.
